RECONSIDERATION OF MERRIAM MOUNTAINS MASTER PLANNED COMMUNITY

Overview
|
|
|
On December 9, 2009 (3), the Board of Supervisors considered the Merriam Mountains project, a master planned community on 2,327 acres of land consisting of up to 2,630 residences, a maximum of 110,000 square feet of neighborhood commercial uses, a fire station, passive and active recreational facilities, and a 1,192 acre biological preserve. I was absent from this meeting because it conflicted with a meeting of the California Air Resources Board, on which I serve, which was considering critical state air quality regulations.
Because of the size of the Merriam Mountains project and its significance in terms of regional population growth, I believe it is important for this project to be considered by the full Board of Supervisors.
I have reviewed the proceedings of the December 9 meeting, and noted that many substantial issues were raised, including water availability, traffic, fire protection, construction related noise, compliance with AB 32 and appropriateness of density in this location. I believe that the substantive issues raised during the December 9, 2009 meeting should be addressed by both staff and the applicant prior to its return to the Board. For that reason, I am requesting that this matter be reconsidered in a future public hearing.
If approved, today’s action will allow for the reconsideration of this project by the full Board of Supervisors. Also, if approved, this action will set a future date for a public hearing.

- Pursuant to County Administrative Code section 375.13 (c), reconsider the matter of Merriam Mountains Master Planned Community; GPA 04-006/ SP 04-006/ R 04-013/ VTM 5381 RPL 4/ STP 04-035/ ER 04-08-028; North County Metropolitan Subregional and Bonsall Community Planning Areas;
- Determine a future hearing date for this matter, direct staff to publish the appropriate Notice of Public Hearing and take all other actions necessary to bring the project forward for reconsideration on that date.

BACKGROUND:
On December 9, 2009 (3), the Board of Supervisors considered the Merriam Mountains project, a master planned community on 2,327 acres of land consisting of up to 2,630 residences, a maximum of 110,000 square feet of neighborhood commercial uses, a fire station, passive and active recreational facilities, and a 1,192 acre biological preserve.
Also scheduled for that day were two critical votes at the California Air Resources Board (CARB), where I have served as a member for the past 15 years. The CARB issues concerned falsified credentials for the lead author of a study used to impose stringent new regulations on diesel exhaust as well as the economic impacts of the regulations on California businesses during a time of deep recession.
Having to attend the CARB meeting in Sacramento forced me to miss the public hearing in San Diego for the Merriam Mountains project. This project received a deadlocked 2-2 vote, failing to obtain a majority of votes, either for approval or denial. A motion to continue the item for a hearing by the full board also failed when it received a deadlocked 2-2 vote.
